Vydavateľstvo Univerzity Mateja Bela v Banskej Bystrici, 2024) Bilasová, BiankaV prípade nejasností o súlade vnútroštátneho práva s právom EÚ, môžu členské štáty počas vnútroštátneho súdneho konania požiadať Súdny dvor EÚ o interpretáciu príslušných ustanovení práva EÚ prostredníctvom prejudiciálneho konania. Kľúčovú úlohu v zabezpečení konzistentnej aplikácie práva EÚ v členských štátoch zohráva práve Súdny dvor. Tento príspevok sa primárne sústredí na výzvy spojené s aplikáciou smernice 2016/343 z 9. marca 2016, ktorá bola prijatá Európskym parlamentom a Radou s cieľom posilniť procesné postavenie osôb podozrivých a obvinených v trestnom konaní. Článok je štruktúrovaný do troch hlavných častí: prvá časť sa zaoberá predstavením sporu vo veci samej a otázok, ktoré boli predložené Súdnemu dvoru Európskej únie. Druhá časť pokračuje analýzou relevantnej judikatúry, smerníc EÚ a procesných záruk, zatiaľ čo tretia časť končí vyhodnotením a interpretáciou rozhodnutia Súdneho dvora.Položka Použitie výpovedí svedkov získaných v neprítomnosti obvineného v kontexte práva na obhajobu: analýza rozsudku Súdneho dvora Európskej Únie C-348/21 (HYA a i.)(Trnavská univerzita v Trnave, 2025) Bilasová, BiankaThe contribution examines the interpretation of Article 8(1) of Directive (EU) 2016/343 of the European Parliament and of the Council in conjunction with Articles 47(2) and 48(2) of the Charter of Fundamental Rights of the European Union, as provided by the Court of Justice of the European Union in its judgment in Case C-348/21 – Criminal proceedings against HYA and Others. The judgment addresses the scope of the accused person’s right to be present at trial, including the right to examine or have examined prosecution witnesses, and sets out the conditions under which the statement of an absent witness may be admitted as evidence in criminal proceedings without violating the principle of a fair trial. The paper consists of three parts: an introduction, an overview of the relevant legal framework, and an analytical section focusing on the examination of the selected judgment. In the conclusion, the author highlights the key findings and outlines the possible direction of future developments concerning the harmonisation of procedural rights in criminal proceedings within the European Union.Položka The right to interpretation and translation as a procedural safeguard of the right to a fair trial in the jurisprudence of the ECtHR and the CJEU(Vytauto Didžiojo Universitetas : Kaunas, 2025) Bilasová, Bianka; Lacyková, Kristína; Bejdová, ZuzanaThis article provides a comprehensive analysis of the right to a fair trial with a particular focus on the right to interpretation and translation as a fundamental procedural safeguard. It examines the multi-layered protection of this right at the international, supranational, and national levels, highlighting the key legal frameworks, including the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, the European Convention on Human Rights (ECHR), and the Charter of Fundamental Rights of the European Union. Special attention is given to the procedural guarantees enshrined in Article 6(3)(e) ECHR and Directive 2010/64/EU, and to the obligations of public authorities and courts to ensure timely and effective interpretation and translation in criminal proceedings. The study explores the practical challenges in securing these rights, particularly in the context of pre-trial detention and the execution of custodial sentences in the Slovak Republic. It addresses the legal distinction between formal procedural rights and the linguistic rights of foreign nationals in detention settings, and examines the role of ombudsman institutions in monitoring compliance. The article also reflects de lege ferenda on possible legislative and practical measures, such as the use of English as an auxiliary language upon admission to detention and the deployment of electronic translation tools, aimed at improving the protection of fair trial rights in an increasingly multilingual and diverse society. The research applies a combination of doctrinal legal analysis, comparative method, and case-law study, complemented by analytical and synthetic approaches to evaluate existing legal frameworks, identify shortcomings in practice, and formulate recommendations for reform.
