Abstrakt
Akrasia is a philosophical concept used in relation to human actions manifesting insufficient self-control or actions that contradict the rational judgment of their originator (performer), while the decision leading to such actions is conscious and not conditioned by any form of coercion. Therefore, it is evident that akrasia is an essential factor in the discussion of human rationality and, at the same time, serves as a stimulus for reflection on the determinants that lead to actions contrary to our judgment. Manifestations of akratic behaviour can be identified in individuals with dissocial personality disorder. Since this personality disorder is a crucial factor in antisocial behaviour, akrasia can also be perceived as an interesting topic in the field of law. Finally, the paper focuses on the theoretical considerations of Stephen J. Morse regarding how recent neuroscientific discoveries relevant to understanding the problem of akrasia might be reflected in law and what the consequences may be.
