dc.description.abstractPolygraph in criminal proceedings in the context of the nemo tenetur principle The polygraph is a special instrument that enables to perform a psychophysiological examination. This examination is based on current scientific development and hopefully could be used as proper evidence in the future. At the present time judicial practice does not accept psychophysiological examination as proper evidence. Despite this fact, expert statements are drawn up about such examinations, which help to obtain additional evidence in criminal proceedings. This paper is dedicated to practical aspects of psychophysiological examination and subsequently the use of such an examination in criminal proceedings with reference to the related regulations of the Penal Code. Finally, it is necessary to deal with the principle of the prohibited self-incrimination and its application during the psychophysiological examination. Protection against self-incrimination is a very important principle that must be respected at every stage of criminal proceedings, even when using a polygraph, in order to ensure the right to a fair trial. That is why it is necessary to use a polygraph and perform a psychophysiological examination in a way that does not violate the principle of prohibition against self-incrimination.
