Abstrakt

Recently, the Slovak Parliament has been showing intensive legislative activity, which is manifested by the approval of new laws, but mainly by repeated changes to already adopted laws. Changes in laws are often a response to specific isolated problems that occur in practice. In this way, the legal order becomes unclear, often internally contradictory and unrecognizable to the addressees of the law. Frequently changing legislation that responds to specific problems does not allow for the creation of stable case-law, which is contrary to the requirement for its predictability and contrary to the principle of legal certainty. The article documents, on the institute of voidability, that the vast majority of problems that arise in the application of legal regulations can and should be solved by the case-law of the courts. In this regard, the Supreme Court has an irreplaceable function, which is the only one authorized and obliged to unify case-law. For this purpose, the author chose the institute of viodability, which is very often used by creditors. The selected case-law is proof that most of the problems that arise in practice can be solved without changing the legislation through case-law, which strengthens the principle of legal certainty.
