dc.description.abstractThe submitted paper explores the legal implications of using market-based substitutes for unpaid labor traditionally performed by household members, focusing on tasks such as childcare, household management, and elder care. The study aims to assess whether paid alternatives—such as caregiving and cleaning services—offer households advantages in terms of financial cost, administrative complexity, time efficiency, service accessibility, and legal certainty. The methodology applies abstraction and analytical approaches to identify key legal features and relationships relevant to replacing unpaid household labor. A comparative method is used to examine different regulatory frameworks and contractual models, while normative (de lege ferenda) analysis evaluates the adequacy of existing laws and suggests potential reforms. The paper also weighs the benefits and drawbacks of various substitution models, considering the unique circumstances of individual households. Particular attention is paid to the legal status of service providers, the nature of contractual relationships, and the overarching regulatory environment. The findings suggest that while informal engagement with service providers carries greater legal risk, it remains the most advantageous option overall. In contrast, establishing a formal employment relationship tends to be the least favorable in terms of legal, administrative, and financial burdens.
