Abstrakt

The contribution examines the interpretation of Article 8(1) of Directive (EU) 2016/343 of the European Parliament and of the Council in conjunction with Articles 47(2) and 48(2) of the Charter of Fundamental Rights of the European Union, as provided by the Court of Justice of the European Union in its judgment in Case C-348/21 – Criminal proceedings against HYA and Others. The judgment addresses the scope of the accused person’s right to be present at trial, including the right to examine or have examined prosecution witnesses, and sets out the conditions under which the statement of an absent witness may be admitted as evidence in criminal proceedings without violating the principle of a fair trial. The paper consists of three parts: an introduction, an overview of the relevant legal framework, and an analytical section focusing on the examination of the selected judgment. In the conclusion, the author highlights the key findings and outlines the possible direction of future developments concerning the harmonisation of procedural rights in criminal proceedings within the European Union.
